These general terms and conditions of sale (GTCS) govern all transactions carried out on the website www.emiliecruz.com for the purchase of textiles, as well as sports coaching, mental preparation coaching, life coaching and ski instruction services. By validating an order, the user accepts these conditions without reservation.

1. Scope of application

The present conditions apply to all sales and services concluded via the website. They may be modified at any time, the applicable conditions being those in force at the date of the order.

2. Products & Services

The store offers :

  • Textile products.
  • Sports coaching, mental preparation coaching, life coaching and ski teaching.

3. Awards

All prices are quoted in euros and exclude VAT (VAT not applicable - article 293 B of the French General Tax Code). Travel, accommodation, food and miscellaneous expenses incurred during Emilie's travels with customers are not included and remain the exclusive responsibility of the customer.
The prices of products and services may be modified at any time, but the rate applied will be that in force at the time the order is validated.

4. Controls

All orders imply acceptance of the present terms and conditions. The customer validates his order after having filled in the information requested on the site and confirmed his payment.

5. Payment

Payment is made exclusively by credit card via a secure system. The full amount of the order must be paid at the time of ordering. No products or services will be delivered or performed until full payment has been received.

6. Delivery of physical products (textiles)

Physical products can be delivered in France and Switzerland. Customers can also pick up their orders free of charge at the following locations:

  • Octoplus-coaching
  • R'Jump Leman

Delivery times are indicative and may vary. The seller is not responsible for delays beyond its control.

7. Right of withdrawal

For physical products, the customer has a period of 10 days from receipt, excluding personalized items (Refunds and Returns Policy) to exercise their right of withdrawal without having to justify their decision or pay any penalties.
Return shipping costs are at the customer's expense. Refunds will be made within 14 days of receipt of items returned in good condition.

Exclusion of the right of withdrawal: In accordance with article L.221-28 of the French Consumer Code, services such as coaching sessions (sports, mental preparation, life coaching) and ski instruction cannot be subject to a right of withdrawal once the service has been provided or begun, at the customer's request.

8. Returns and refunds

Returned textile products must be in perfect condition. If a product has a defect, the customer may request an exchange or refund under the legal warranty conditions.

9. Execution of services

Coaching and ski instruction services are provided by appointment, following validation of the order. In the event of cancellation by the customer, no refund will be made.

10. Legal warranties

The seller is bound by the legal guarantee of conformity for textile products sold (articles L.217-4 to L.217-14 of the French Consumer Code) and the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code). In the event of a lack of conformity or hidden defect, the customer may obtain a replacement or refund for the defective products.

11. Liability

The seller declines all responsibility in the event of misuse of the products purchased. Coaching and ski instruction services are provided on an advisory and support basis, but the customer remains responsible for the application of the advice given.

12. Personal data

The information collected on the site is necessary for order management. It is processed in accordance with the General Data Protection Regulation (RGPD). Customers have the right to access, rectify and delete data concerning them.

13. Intellectual property

All elements of the site (text, images, logos) are protected by copyright and may not be reproduced without prior authorization.

14. Applicable law and settlement of disputes

These terms and conditions of sale are governed by French law. In the event of a dispute, the customer may have recourse to mediation or lodge a claim with the competent French courts.
